Court Orders the Arrest of Ndichu Brothers

The court has issued an arrest warrant against two brothers- Paul Ndichu and Edward Ndichu after they once again failed to appear in court for their assault case.

According to Kibera chief magistrate Ann Mwangi,  she ordered the police to arrest the duo.

"Since the accused person is not in court despite a court order I, therefore, issue a warrant of arrest against them," Mwangi ruled.

The lawyer holding brief in the matter had told the court that the accused persons' lawyer was in another matter at the high court.

"I am holding brief in the matter and I have instructions to ask for another date since their lawyer is in another matter at the high court," he said.

Lawyer Phillip Murgor had told the court in the previous session that the accused person was taking the court for granted after Edward failed to appear in court for plea taking.

One of the Ndichu brothers was charged with assault and malicious damage.

He was later released on Sh100,000 bond with cash bail of the same amount.

Last week, a Kibera court was told that Edward Ndichu failed to take a plea for a third time after saying he tested positive for Covid-19.

This came after he failed to take a plea on the ground that his employer refused to give him time off to attend court.

Their lawyer said the accused person contracted the virus on March 12. 

“One of the accused persons is in quarantine isolating himself after showing some symptoms related to Covid-19, while Edward contracted the virus on March 12. We expect them out on March 26,” the lawyer told Kibera chief magistrate Ann Mwangi.

The lawyer gave the court Edward's Covid-19 certificate as proof.
