According to Khaemba, who reported the incident to Kimilili sub-county police, the incident occurred around 6 p.m. when they went to Chebukwabi polling station to witness the vote counting.

Barasa applied to the court for anticipatory bail pending his arrest in connection with the shooting incident in which his main rival's aide was killed.

Barasa also claimed that the Directorate of Criminal Investigations (DCI) had not thoroughly investigated the matter in court papers filed at the High Court in Milimani, Nairobi.

Furthermore, he claimed that the victim, Mr. Brian Olunga, was a member of a hit squad dispatched from Nairobi and was killed by a stray bullet.

"According to a reliable source, the deceased was part of a hit squad that was deployed from Nairobi and was in fact killed by a stray bullet due to wrangles with his confidants. Mr. Barasa has been branded a murderer without due process being followed thus prejudicing his right to a fair trial...hence the need for the court to grant him bail pending arrest," Barasa's lawyer Dr. John Khaminwa stated.

"It is paramount that this court grants him bail so that his right to a fair trial is not hindered. Mr. Barasa is a leader. He is aware of the importance of the rule of law and if granted bail pending arrest, he will present himself willingly to the authorities so that the full force of law can be exerted," the laser added.

The victim, Brian Olunga, died while receiving treatment at Kimilili sub-county hospital.
