Ex Kangema MP Tirus Ngahu Laid to Rest after Resolved Land Dispute

This comes after the High Court overturned a lower court's judgment prohibiting his burial after his death took place on February 13, 2022, at a Nairobi hospital where he succumbed to Stomach Cancer.

A magistrate's court in Muranga issued court orders on February 15th further stoping his burial due to a land dispute.

This was after a family filed a petition to halt the funeral, alleging that the land Ngahu's family planned to bury him on was obtained improperly.

However, Gabriel Macharia Njoroge told senior principal magistrate P M Kiama in a signed declaration that he was appointed administrator of his father's property after his death in 1992.

Macharia claimed in a lawsuit that Ngahu's wife, Lydia Njoki, was the defendant, that the former MP had a faulty title deed for land piece LR No Loc9/Kiruri1262.

On Wednesday, February 23, 2022, Justice L. N. Gicheru of the Environment and Land Court overturned the lower court's orders.

According to Justice Gicheru, ELC No. 47 of 2017 and O.S No. 21 of 2021, which were mentioned in SPM ELC NO. E001 of 2022 at Kangema, are closed and hence not extremely controversial, as the respondent claims.

While delaying the lower court's decisions, the judge ordered that an inter-party hearing be held in open court on February 28, 2022.
