The allegation that Dagoretti South MP Deniss Waweru and his Suna East counterpart Junet Muhammed were factually inaccurate, according to Ouko, who believes the President is precluded from starting constitutional revisions through the popular initiative.

The President's involvement in launching a popular initiative, according to Justice Ouko, rendered the process invalid.

"The President cannot run with the hares and hunt with the hounds," Justice Ouko explained in his Thursday ruling.

According to the judge, after President Uhuru Kenyatta and his then-archrival Raila Odinga agreed to halt hostilities after the 2017 presidential election, the BBI process was born.

Justice Ouko maintained that the popular initiative is confined to the general public, rejecting BBI supporters' claims that Waweru and Junet were the promoters of the constitutional amendment Bill that was declared illegal by both the Constitutional Court and the Court of Appeal.

In terms of public participation, Justice Ouko found that the people's promoters did a good job.
