Kenyan Artist, Nonini to Sue Syinix Electronics For Copyright Infringement

Hubert Mbuku Nakitare, commonly known by his stage name Nonini has today sued Syinix Electronic after it used one of his songs to advertise one of its products without his permission.

In a video seen by this publication, the advert used part of the 'We kamu' song in advertising a TV set to its customers. 

According to the statement issued, the video was published on April 30, 2022, by an influencer named Brian Mutinda who posted the short clip on his Instagram page to advertise the product.

The advert was also shared on syinix electronics' Facebook page without Nonini's permit.

According to the statement, the owner of the song was denied the synchronizing right on the advert. 

From the statement released, the song owners now demand the following from the publishers of the advert:

1. Immediate pulling down of the videos from the social media pages

2. Issuing of public apology in the same magnitude as the client and the same is to be posted on both Syinix electronics verified Facebook page and the Influencer's Instagram account and any other social media accounts held by both parties where the same was reposted.

3. Both parties are to admit liability within the next 7 days.

Failure to accomplish the above demands, the matter will proceed to the court of law for the next step to be handled.

"Should you choose to ignore this demand, we have mandatory an unequivocal instruction from our client to institute legal proceedings against both of you in a court of law," read part of the statement.

Nonini has also cautioned artists to be careful with companies or people who use their art without their permission to benefit themselves.

"Music rightsholders know how to defend their rights, and not having a sync license puts your company at risk. The music industry earns its revenue from copyrights and so music rights holders please take legal action against any form of infringement," Nonini cautioned.
