Moses Kuria: I will Support Implementation of BBI if it Passes

In a post on his social media account on Thursday, March 31, 2022, Kuria argued that the problem with BBI was not its content but the process of passing it.

"The problem with BBI was never solely the substance; it was the process. The net effect of the Supreme Court ruling today will be a remedy to all the process maladies. If the SC rules in favour of BBI, that will cleanse the process. I will be at the forefront in pushing for immediate implementation," Kuria wrote.

The Supreme court is today set to deliver its ruling on the drive, which was found unconstitutional, null and void by the Court of Appeal on August 25, 2021.

The Supreme Court will issue a ruling on the validity of the document and whether the right process was used in fronting it as a Constitutional amendment process.

The apex court will also issue its verdict on whether the President, who initiated the process alongside ODM leader Raila Odinga, can be sued in his personal capacity.

The ruling, which could shape the August polls, will also determine the threshold of public participation and if the BBI process complied.

The Supreme Court will also give a ruling on whether the Independent Electoral and Boundaries Commission was legally constituted when it processed the BBI Bill.
