Gatundu South MP Moses Kuria has filed a case at the Milimani law court challenging IEBC's decision to summon him over election rigging remarks.

MP Moses Kuria Goes to Court Over IEBC Summons on Poll Rigging Claims

He claims that his right to a fair hearing and fair administrative action has been violated, adding that IEBC has assumed jurisdiction it lacks.

"The conduct by the respondents is unbecoming of public officers," he argues.

"The applicant, being aggrieved by the said actions of the respondent has thus filed this application in order to seek redress from this Honorable Court pursuant to the Court's jurisdiction," reads court papers

Kuria argues that IEBC has proceeded to assume non-existent jurisdiction and the law to harass him.

He claims that he honored the said summons; however, he accused the commission of turning it into a hearing despite having failed to give him prior notice.

On March 15, Kuria said he and other political leaders helped President Uhuru Kenyatta secure victory in both elections through dubious means.

Kuria made the claims during the United Democratic Alliance party delegates conference at the Kasarani Gymnasium Arena.

Uhuru's victory was challenged by his main challenger, ODM leader Raila Odinga, in both the 2013 and the 2017 general elections. The Supreme Court canceled the later election results.

"Kuna wengine wanasema ati kura ya mlima itagawanywa; mheshimiwa Ann Waiguru, Rigathi Gachagua, Muthomi Njuki, Kimani Ichung’wa, Senator Linturi, Alice Wahome, Faith Gitau, Kimani wa Matangi…Sisi ndio tulikuwa tukishikilia Uhuru kura, na sisi ndio tulikuwa tunamuibia kura,” Kuria said.
