Director of Public Prosecutor Nordon Haji is against the plot to assign Senator James Orengo as a representative to former Transport Cabinet Secretary Michael Kamau in a graft case.

The former CS faces charges of abuse of office and willful failure to comply with applicable procedures and guidelines relating to the management of public funds.

Special prosecutor James Kihara reasons that Orengo’s presence in the case will be in conflict with his senator role and urged the accused to employ a counsel that’s not a state officer.

“Though he is entitled to practice law, such practice should not conflict with the public interest that is under a duty to protect,” the application stated.

Despite the office of the DPP being aware of one’s right to a counsel of their choice, the right is not absolute, especially where conflict of interest is stated.
