The Court of Appeal through Justices Roselyne Nambuye, Wanjiru Karanja and Sankale ole Kantai suspended the proceeding of a five-judge High Court bench hearings of 10 petitions relating to ex-Chief Justice David Maraga’s advisory on dissolution of parliament due to gender part rule.

Justices conclusion to ruling off the proceedings was because the appeal was not filed by the National Assembly and had no senate hearing.

The appeal of the Houses is as a result of their dismissal of their case questioning Deputy Chief Justice Philomena Mwilu’s power when she established the bench.

The appointed five-judge that included Justices George Odunga, James Makau, Anthony Ndungu and Pauline Nyamweya was majorly to listen to the cases that concerned the advisory which was actively dismissed by Speakers Justin Muturi (National Assembly) and Kenneth Lusaka (Senate) of  being unconstitutional.

Arguments were made regarding the DJC’s actions of empanelling a bench as an exercise beyond her power since that power is only reserved for the Chief Justice but was later dismissed by the the five-judge bench of  Justices Lydia Achode, Pauline Nyamweya, George Odunga, James Makau and Anthony Ndung'u agreeing that the Chief Justice powers can be substituted to the deputy and commenced to hear the petitions.

The ruling hurt the Legislature forcing them to file an application for stay of the proceedings pending determination of its appeal.
