Rashid was accused of killing Mohammed Dhair and Jamal Mohamed, the two teenagers were from Eastleigh.

Rashid faces possibility of being detained after claiming he had not received notice to appear in court on December 8 for a plea hearing.

However, his attorney vowed to bring him to court and the plea-taking was consequently postponed to January 23, 2023.

Additionally, Omari demanded that the Independent Policing Oversight Authority (IPOA) and the Directorate of Public Prosecution (DPP) demonstrate that Rashid was the one who fired the rounds that killed the two teenagers.

The prosecutor would need to demonstrate beyond a reasonable doubt that his client was the plain-clothes police in the widely circulated video, the attorney claimed in a statement to NTV.

"Our client never shot anybody. The burden of who shot the people is the government's responsibility. In this country, there is nothing such as self-incrimination.”

"Let the government produce incriminating evidence that Seargent Ahmed Rashid did shoot, and explain whether it was manslaughter or murder," Omari said.

Rashid defended his innocence in an affidavit, claiming that numerous cops were involved in the operation and that he was not a murderer as had been claimed.

"I can confirm that I am not a criminal or murderer as portrayed. I have never used my firearm other than within the permitted parameters of the National Police Service Act," the affidavit read in part.

The officer further denied accusations that he killed innocent Kenyan citizens by claiming that the operation was known to provincial commissioner and then-inspector general of police Japhet Koome.

He contended that Dhair and Mohamed were thugs who had been positively identified at the spot by all victims of the criminal organization.

Rashid further said that the IPOA had not called him to testify in the matter.
