Senator Samson Cherargei of Nandi will now spend the weekend in police custody after a Nairobi court postponed the hearing on his ethnic contempt case.

Cherargei was presented at the Milimani Law Courts on Friday after a warrant of arrest was issued against him for failing to appear for the case hearing on April 19, 2022.

The Senator, who was arrested on Thursday and spent the night in a police cell, presented a document to the court indicating that he was ill, according to his advocates.

Cherargei became ill on April 17, 2022, and went to Eldoret for treatment, where he was advised to take bed rest for 7 days, according to the advocates.

The prosecution, on the other hand, questioned the document, claiming it was written in Chinese, and the magistrate mocked it because she couldn't read it.

Cherargei was sent to police cells on the basis that the trial magistrate was not present, and that the prosecution failed to agree with the defence on his release terms.

Milimani Senior Principal Magistrate Esther Kimilu, filling in for Chief Magistrate Wendy Micheni, ordered the accused to be remanded at Gigiri Police Station.

Magistrate Kimilu set the matter for mention on Monday, April 25, for Trial Magistrate Micheni to deal with in person.
