The supreme court of Kenya through Chief Justice Martha Koome affirmed on Monday 5th that President-Elect William Ruto had attained 50+1 votes in the August 9th General elections.

Koome further supported Ruto`s election and subsequent designation as the next president of Kenya and the country's fifth leader.

Chief Justice Martha Koome highlighted in her reading of the seven-judge panel's decision on Monday, September 5, that Wafula Chebukati, the IEBC chairperson, had correctly stated that the threshold had been met.

"We have found that the rounding off done by IEBC is correct. The petitioners did not also provide watertight evidence to show that none of the candidates met the 50 plus 1 requirement.

"We affirm that rejected votes cannot be added to votes cast when calculating whether the candidates meet the 50 plus 1 threshold," Koome stated.

Regarding claims that ballot boxes were stuffed in favor of Ruto, the supreme court remarked that the petitions did not provide enough evidence to convince the court of this.

"The petitioner did not produce any evidence to support the claim that there was any voter stuffing in Rift Valley and Mount Kenya region. We find therefore there are no major discrepancies in the number of votes cast for the presidency and that of the other elective seats," the court ruled.

The petitioners, particularly Okiya Omutatah, stated that none of the nominees received the required 50% plus 1 vote during the hearing.

The senator-elect for Busia stated in a PowerPoint presentation on August 31 that additional votes cast by ghost voters were added to the overall number of votes cast to give Ruto a 50 percent plus one victory.

A day after polls closed, over 500,000 votes were still relayed via the KIEMS kit, according to Omutatah, who also noted that Chebukati frequently changed the voter turnout during the campaign.

“IEBC Chairman Wafula Chebukati announced that 14, 213,137 total votes were cast for all presidential candidates. The values and percentages attributed to all presidential candidates are fictitious.

“These figures are cooked. They worked backwards to achieve a certain figure, but, fortunately, in Form 34C, the smoking gun is seen. Since figures don’t lie, if the maths does not add up, then this court should quash the results,” activist Omutatah stated.
