Kuria's application sought that the IEBC be barred for determining whether the Vote rigging claims he made against the IEBC were against the Electoral conduct.

Gatundu South Member of Parliament Moses Kuria has lost his first fight with the Independent Electoral and Boundaries Commission over Vote- rigging claims that he made when he was attending the United Democratic Alliance Party’s (UDA) National Delegates Convention (NDC) at the Kasarani Gymnasium on the 15th of march 2022.

Kuria Is alleged to have said that he and other Jubilee-inclined MPs “helped President Uhuru Kenyatta steal the vote” in the 2017 polls.

On its part, the IEBC through its chairman Wafula Chebukati has issued a verdict that Kuria breached the commission’s code of conduct by raising the credibility of the 2017 election results.

Kuria was represented before the committee by lawyers Ndegwa Wahome and Geoffrey Omenke.

According to the lawyers IEBC is not mandated to hear the case because the matter falls under the jurisdiction of the National Cohesion and Integration Commission (NCIC).

The high court ruled that this committee has no jurisdiction to preside over this matter,” Wahome said.

It will only be prudent that we wait for ruling on IEBC’s jurisdiction by the high court, IEBC Commission cannot be the complainant, prosecutor & the judge. It will be biased in arriving at its judgement," he added.  

IEBC’s Chairman Wafula Chebukati said that the Election Act binds all political party candidates as well as the government.

Kuria on his part has said that he would go to court to stop the IEBC from hearing the matter.

“I am heading to the court to stop IEBC from presiding over the so called hearing,” the controversial MP stated.

According to the IEBC, the matter will now be heard on April 7.
