In a ruling by Justice Anthony Mrima, the Court ruled that the Independent electoral and Boundaries Commission (IEBC) did not have any authority to summon politicians before they are formally nominated and determined as independent candidates.

The code of conduct does not apply as candidates have not yet been determined and subscribed to it. IEBC committee does not have jurisdiction to issue summons,” Mrima ruled.

Also, Justice Mrima went on to reject the argument by the IEBC that once the date of election has been gazetted, politicians are bound by its Code of Conduct.

Chege was being represented in Court by Lawyers, James Orengo and Otiende Amolo and according to the two lawyers the IEBC was sitting in a case that the Supreme court had directed it to open servers in order for the court to authenticate the integrity of the 2017 elections.

The lawyers further went on to say that the summons by the IEBC were not in good faith and were aimed to embarrass and tarnish Chege’s reputation.

On her part, Sabina went on thank the Court for the ruling on her favor. Speaking in Turkana during a political rally to campaign for Azimio flagbearer, she added that the IEBC should concentrate on ensuring a credible election in August.
