The high court of Kenya has granted permission to the Directorate of Criminal investigations to investigate the English Point Marina Developer over money laundering allegations.

However, the developer has filed a petition to the court to stop the probe saying that the issue was being handled in a civil suit that was filed by 12 apartment owners.

According to Justice Mativo, the objectives of the two matters had already been differentiated and the investigation would not overlap the other lawsuit.

The lawsuit by the apartment owners was meant to address possible discrimination of African owners while the Investigations were meant to address money laundering scheme.

The English Point Marina is a luxurious property that is located at the shore of the Indian ocean containing 96 apartments, 8 penthouses and a hotel with 26 rooms.

In the lawsuit by the 12 apartment owners, the developer is being accused of discriminating against them and they in turn hired John Khaminwa to represent them in court.

Khaminwa, representing the apartment owners in court expressed how the developer has been mistreating the apartment owners.

“For instance, the apartment owners are required to serve an earlier notice to the management before visiting their apartments, which is an absurd requirement,” Argued Khaminwa.

“The management declined to allow the apartment owners’ servants access to their units for purposes of cleaning the units and keeping the same in a habitable condition in the absence of the owners,” Khaminwa further added.
